1. Scope

These terms and conditions of sale (hereinafter the “Terms”) govern the contractual relations between Lina Hadid, Av. de Provence 4, 1007 Lausanne, Switzerland, reachable at lina@mentalsofa.com (hereinafter “Mental Sofa”) and any natural or legal person (hereinafter the “Client”) having booked or purchased one or more services offered by Mental Sofa.

2. Nature of the services

Mental Sofa offers mental support in the field of personal development. This support constitutes neither medical therapy nor psychological treatment in the clinical sense. In the event of a particular need or of an issue falling within the medical or psychotherapeutic field, Lina Hadid reserves the right to direct the Client to a qualified health professional.

3. Composition of a programme

Each programme brings together a set number of conversations, the work and the exchanges between them, and a book from the collection given with the programme. The three programmes offered to date are:

  • Leaders · ten conversations of 30 minutes.
  • Mental load · eight conversations of 30 minutes.
  • Couples · six conversations of 45 minutes, together.

A follow-up call is offered about six weeks after the last conversation of the programme. The details of each programme appear on the page devoted to it and, in the event of a discrepancy between that page and these Terms, the offer page in force on the date of the order prevails.

4. Booking

The first call of 15 minutes, free of charge, is booked directly online through the booking platform available on the site.

Programmes are ordered at the end of this first call, through the booking platform, by email or by message. The order is firm and final once full payment has been received.

Conversations are not booked online: their times are agreed directly with Mental Sofa, for all three programmes.

Conversations take place in person at Av. de Provence 4, 1007 Lausanne, or remotely by video, at the Client’s choice. For the Leaders programme, they can also take place by phone. For conversations by video, the connection link is sent by Mental Sofa before the conversation, to the email address provided by the Client.

5. Priority access on the Leaders programme

The Leaders programme includes priority access. This covers two commitments:

  • when several appointment requests come in, those of Clients on the Leaders programme are handled first;
  • the choice of format is open at each conversation, phone included.

Priority access concerns the order of handling, not a set deadline: it constitutes neither a guarantee of immediate availability, nor a commitment to an appointment within a stated time. It applies during Mental Sofa’s periods of activity, excluding closures announced in advance.

6. Minors

Mental Sofa welcomes Clients of full age and, from the age of 14 completed, minor Clients.

For a minor, the support begins once Mental Sofa has received written authorisation signed by the legal representative. This authorisation identifies the legal representative, designates the programme concerned and covers its entire duration. The legal representative is the contracting party: they order the programme and pay its price.

The content of the conversations remains confidential, including towards the legal representative. The latter is kept informed of the framework: programme followed, conversations held, continuation or ending of the support. They are informed without delay if the Client’s safety appears to be at stake.

The minor Client can end the support at any time. As for any Client, Mental Sofa directs them to a qualified health professional as soon as the situation calls for it (article 2).

7. Prices and payment

The prices of the services are given in Swiss francs (CHF), all taxes included.

Full payment is required at the time of the order. Payment is made by the means offered at the time of the order. No payment in instalments is offered to date.

8. Validity and use of the programmes

The conversations included in a programme are valid for six months from the date of purchase, for all three programmes.

After that period, unused conversations lapse and give no right to any refund or transfer.

Article 10 further reserves cases of force majeure and of medical incapacity.

9. Cancellation, postponement and absence

Cancelling or postponing a conversation is possible free of charge up to 24 hours before the scheduled time.

The cancellation or postponement request can be made through the booking platform, or sent by email, WhatsApp message or telephone call.

After that period, the conversation is due in full, except in the cases defined in article 10. Conversations cancelled within the deadline can be rescheduled during the programme’s validity period, subject to availability.

10. Force majeure or prolonged incapacity

In the event of force majeure or of proven medical incapacity (illness, hospitalisation, accident) making the temporary or definitive continuation of the support impossible, the Client can request, on presentation of a medical certificate or a legal supporting document, either:

  • an exceptional postponement of the programme’s validity period;
  • or a refund pro rata to the unused conversations.

No suspension, extension or refund request will be accepted for personal, professional or logistical reasons, in the absence of a valid medical or legal supporting document.

11. No refund and no transfer

All payments made are firm and final. Programmes are strictly personal, non-refundable and non-transferable, save for exceptions expressly provided for in these Terms.

12. Confidentiality and framework

All conversations are covered by confidentiality.

Mental Sofa undertakes to respect the Client’s privacy and to guarantee the protection of the information exchanged, in accordance with the ethical rules applicable to the practice of professional support. No information will be disclosed to third parties without the Client’s explicit consent, save for a legal obligation.

13. Limitation of liability

The support framework offered by Mental Sofa has no medical or therapeutic purpose in the legal sense of the term.

The Client remains fully responsible for their decisions, their actions and their consequences, including after the conversations.

Within the limits permitted by Swiss law, Mental Sofa declines all liability for indirect or non-material damage resulting from the use, the interpretation or the implementation of the content addressed during the conversations.

Liability for wilful misconduct and for gross negligence remains in full, as does liability in the event of harm to life, to physical integrity or to health.

14. Personal data

The Client’s personal data is collected and processed in strict compliance with the applicable legislation, in particular the Federal Act on Data Protection (FADP).

Mental Sofa undertakes to use this data only for purposes strictly linked to the contractual relationship, to the management of appointments and, where appropriate, to the communication of useful or relevant information.

The purposes, the Client’s rights and the security measures are detailed in the privacy policy.

15. Changes to the Terms

Mental Sofa can amend these Terms and Conditions of Sale. Any change is published on the site and takes effect on that date.

A change does not apply to a programme already ordered. The conditions governing a programme are those in force on the date of its order, and they govern it until its end.

16. Applicable law and place of jurisdiction

These Terms are governed exclusively by Swiss law. As regards jurisdiction, any dispute concerning their interpretation will be submitted to the ordinary courts of Lausanne.
